When choosing a life partner that one decides to spend the rest of their life with, there are no guarantees of what the future holds. “Happily ever after” seems to be an attitude only present in fairy tales. This has become more evident with the surge in divorce cases in recent times.

The Law Offices of Malcolm S. Babel works exclusively on family law and matrimonial matters. Mr. Babel has been an attorney for over 40 years We act on behalf of an individual that wishes to get a separation from the person to whom she or he is married to.

Individuals wishing to separate from their spouses need our services to proceed with their divorce. There are a lot of matters involved that need to be resolved. The issues to be resolved include custody and support of children (if any), maintenance (alimony) and distribution of marital assets.

At the Law Offices of Malcolm S, Babel, our responsibility is to represent as well as argue the case on our client’s behalf. We are also responsible for guiding our client as to what constitutes the best for him or her. We always try for a Truce but are always prepared to Battle.

It is also essential that we build a good rapport with our clients. On our end, the client must be apprised of all procedures and dealings with the court. These aspects ensure that there are no surprises during the entire legal process.

Moreover, the relationship between us and our client can work better when we team together. Despite the trauma when one faces separation and subsequent divorce, it is critical to ensure our clients that they feel their issues are being handled as fast as possible without any compromises. This enables an otherwise trying phase to be made at least a little easier.

New York is a “no-fault” divorce state. This means that one of the grounds for a divorce in New York is the assertion that the marriage has been “irretrievably broken” for at least 6 months prior to the commencement of any divorce action. No further proof is required. Most divorces end up with this ground. It allows for a divorce without retaliatory accusations and makes the procedure as painless as possible; particularly if agreements can be easily reached on other issues including children and support and distribution of marital assets. Please note that a divorce will not be granted until all issues are resolved and agreed to. If the parties can not do this themselves, then a trial will take place and a judge will make all final decisions, whether custody, child support, maintenance or equitable distribution of marital assets.

There are six other grounds for divorce in New York:

  1. Cruel and inhuman treatment;
  2. Abandonment;
  3. Imprisonment for three consecutive years;
  4. Adultery;
  5. Living separate and apart pursuant to a separation judgment or decree for at least one year; and
  6. Living separate and apart pursuant to a separation agreement for at least one year.

I can also give you advice on:

Separation Agreements
Orders of Protection/Domestic Violence
Distribution of Marital Assets
